Terms of Service

1. Introduction

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Serkan Berk Bilgiç, a sole proprietorship registered in Istanbul, Turkey ("HairTry", "Company", "we", "us", "our"), governing your access to and use of the HairTry mobile application ("App") and all related services ("Services").

By downloading, installing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

2. Description of Service

HairTry is an AI-powered hair visualization application. The App allows users to upload a photo (selfie) and preview different hairstyles by using artificial intelligence image generation technology. The App utilizes third-party AI services (Google Gemini and OpenAI) to generate hairstyle previews based on user-provided photos and selected hairstyle templates.

Disclaimer: HairTry is not affiliated with Google, OpenAI, or any other AI service provider. We utilize their official APIs under service agreements to deliver the technology.

3. Eligibility

You must be at least 13 years old (or 16 in the EEA) to use HairTry. If you are under 18, you confirm that you have your parent or guardian's consent to use the App and agree to these Terms. We do not knowingly collect data from or provide services to children under these age limits.

4. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal device strictly for your personal, non-commercial use.

You may not:

• License, sell, rent, lease, assign, distribute, or otherwise commercially exploit the App;
• Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the App;
• Remove, alter, or obscure any proprietary notices (including copyright or trademark notices);
• Use the App to develop a competing product or service;
• Use automated systems, bots, or scrapers to access the App.

5. User Accounts

HairTry uses anonymous authentication via Firebase. You do not need to provide personal information such as an email address, phone number, or name to use the App. Your account is tied to your device. It is your responsibility to keep your device and access to the App secure.

6. Subscriptions and Payments

6.1 Subscription Plans

HairTry offers optional auto-renewable subscription plans (weekly and yearly) that provide credits for AI hairstyle generation and access to premium features (such as premium AI models).

6.2 Billing

• Subscriptions are billed through the Apple App Store or Google Play Store ("Stores"). Payment is charged to your Store account at confirmation of purchase.
• All prices are displayed in your local currency as determined by the Store.
• We reserve the right to change subscription prices. Any price changes will apply to the next billing cycle after the change is posted.

6.3 Auto-Renewal

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• Your Store account will be charged for renewal within 24 hours prior to the end of the current period at the same price.

6.4 Cancellation

• You can manage or cancel your subscription at any time through your device's Store settings (iOS: Settings → Apple ID → Subscriptions; Android: Google Play → Subscriptions).
• Cancellation takes effect at the end of the current billing period. You will continue to have access to premium features until that date.
• Deleting the App does not cancel your subscription.

6.5 Refunds

Refunds are handled by Apple or Google according to their respective refund policies. We do not process refunds directly. To request a refund, contact the Store through which you made the purchase.

6.6 Free Trials and Introductory Offers

We may offer free trials or introductory pricing for certain subscription plans. Trial eligibility is determined by the Store. If you do not cancel before the trial period ends, you will be automatically charged at the standard subscription rate.

7. Credits

• Credits are granted upon subscription purchase and upon each renewal.
• Free users receive a limited number of credits upon first use.
• Credits are non-transferable and have no monetary value.
• Unused credits accumulate — there is no cap on credit balance.
• If an AI generation fails due to a system error (not a content policy violation), the spent credit is automatically refunded to your balance.
• Free credit offers may be modified or discontinued at any time at our discretion.

8. User Content

• Ownership: You retain full ownership of photos you upload to HairTry.
• License to us: By uploading a photo, you grant us a limited, non-exclusive license to process the image solely for the purpose of generating hairstyle previews as part of the Service. This license terminates when you delete your content or account.
• AI-generated results: AI-generated hairstyle preview images are provided to you for personal, non-commercial use. You may save and share them freely for personal purposes.
• No misuse: You agree not to upload content that is illegal, offensive, harmful, or violates third-party rights (including uploading photos of others without their consent).

9. AI-Generated Content Disclaimer

Results generated by AI are approximations and artistic interpretations. HairTry does not guarantee that:

• Generated images will accurately represent how a hairstyle would look on you in real life;
• Results will be consistent across multiple generations;
• The AI service will be available at all times without interruption.

Results may vary depending on photo quality, lighting, face angle, and other factors. You acknowledge that AI-generated content may contain imperfections or artifacts.

10. Acceptable Use

You agree not to:

• Use the App for any illegal or unauthorized purpose;
• Upload photos of other people without their explicit consent;
• Attempt to circumvent credit limits, payment systems, or security measures;
• Use the App to generate content that is offensive, discriminatory, or harmful;
• Interfere with or disrupt the App's servers or networks;
• Attempt to access other users' data or accounts.

11. Intellectual Property

The App, including its design, code, AI integration, user interface, branding, and all related content (excluding user-uploaded photos), is owned by HairTry and protected by applicable intellectual property laws. All rights not expressly granted in these Terms are reserved.

12. Third-Party Services

The App relies on third-party services (Firebase, Google Gemini, OpenAI, RevenueCat) for its core functionality. We are not responsible for the availability, accuracy, or policies of these third-party services. Your use of the App is also subject to the terms and conditions of the Stores through which you download it (Apple App Store, Google Play Store).

13. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We do not warrant that the App will be uninterrupted, error-free, secure, or free of harmful components.
• In no event shall HairTry, its owner, or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.
• Our total aggregate liability shall not exceed the amount you actually paid to us through the App in the 12 months preceding the event giving rise to the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless HairTry and its owner from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your violation of any third-party rights.

15. Account Deletion

You may request deletion of your account and all associated data at any time by contacting us at sberk.bilgic@gmail.com. Upon receiving your request, we will delete your account and all associated personal data within 30 days, except where retention is required by law.

16. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, with or without notice, including but not limited to cases where you violate these Terms. Upon termination:

• Your license to use the App ceases immediately;
• You must stop using the App and delete it from your device;
• Your active subscription will not be automatically canceled — you must cancel it through your Store settings;
• Termination does not affect any rights or obligations that accrued before termination.

17. Modifications to the App

We reserve the right to modify, update, suspend, or discontinue the App or any of its features, temporarily or permanently, at any time and without prior notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the App.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by updating the "Last updated" date at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the App.

19. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising from or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts and consumer arbitration committees of Istanbul, Turkey.

20. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed from these Terms and shall not affect the validity and enforceability of the remaining provisions.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HairTry regarding your use of the App and supersede all prior agreements and understandings.
