These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Serkan Berk Bilgiç, a sole proprietorship registered in Istanbul, Turkey ("Calquate", "Company", "we", "us", "our"), governing your access to and use of the Calquate mobile application ("App") and all related services ("Services").
By downloading, installing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.
Calquate is an AI-powered calorie and nutrition tracking application. The App lets you log meals manually or get an automatic nutrition estimate by submitting a meal photo or text description, which is analyzed using third-party artificial intelligence (OpenAI). The App then helps you track calories and macronutrients against personalized daily goals.
Disclaimer: Calquate is not affiliated with OpenAI or any other AI service provider. We use their official API under a service agreement to deliver the technology.
Calquate is a general wellness and informational tool. It is not a medical device and does not provide medical, nutritional, or dietary advice, diagnosis, or treatment. Calorie and macronutrient values are AI-generated estimates and may be inaccurate. Always consult a qualified healthcare professional before making decisions about your diet, especially if you have a medical condition, allergy, eating disorder, or are pregnant. You use the App's information at your own risk.
You must be at least 13 years old (or 16 in the EEA) to use Calquate. If you are under 18, you confirm that you have your parent or guardian's consent to use the App and agree to these Terms.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal device strictly for your personal, non-commercial use.
You may not: license, sell, rent, lease, or commercially exploit the App; modify, reverse engineer, or create derivative works of it; remove proprietary notices; use it to develop a competing product; or use automated systems/bots to access it.
Calquate uses anonymous authentication via Firebase. You do not need to provide personal information such as an email address, phone number, or name to use the App. Your account is tied to your device. Because accounts are anonymous, uninstalling the App or switching devices may result in loss of access to your logged data; a restored subscription can still be recovered via "Restore Purchases".
Manual meal logging is free. AI meal analysis is offered with a limited number of free uses; unlimited AI analysis and premium features require an optional auto-renewable subscription.
Calquate offers weekly and yearly auto-renewable subscription plans. The yearly plan may include a free trial.
If a plan offers a free trial, you will not be charged during the trial period. If you do not cancel at least 24 hours before the trial ends, you will be automatically charged the standard subscription price. Any unused portion of a free trial is forfeited when you purchase a subscription.
Refunds are handled by Apple or Google according to their respective policies. We do not process refunds directly. To request a refund, contact the Store through which you made the purchase.
Nutrition values produced by AI are estimates and approximations. Calquate does not guarantee that calorie or macronutrient figures are accurate, that results are consistent across analyses, or that the AI service is available without interruption. Results vary with photo quality, portion size, and other factors.
You agree not to: use the App for any illegal purpose; attempt to circumvent usage limits, payment systems, or security measures; interfere with the App's servers or networks; or attempt to access other users' data.
The App, including its design, code, AI integration, user interface, and branding (excluding user-submitted content), is owned by Calquate and protected by applicable intellectual property laws. All rights not expressly granted are reserved.
The App relies on third-party services (Firebase, OpenAI, RevenueCat) for its core functionality. We are not responsible for the availability, accuracy, or policies of these services. Your use of the App is also subject to the terms of the Stores through which you download it.
You agree to indemnify and hold harmless Calquate and its owner from any claims, liabilities, damages, losses, and expenses arising out of your use of the App, your violation of these Terms, or your violation of any law or third-party right.
You may request deletion of your account and all associated data at any time by contacting us at sberk.bilgic@gmail.com. We will delete your account and associated personal data within 30 days, except where retention is required by law.
We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice, including where you violate these Terms. Upon termination, your license ceases, you must stop using the App, and you must cancel any active subscription through your Store settings.
We reserve the right to modify, update, suspend, or discontinue the App or any feature at any time without prior notice, and shall not be liable for any such change.
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date. Continued use of the App after changes constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Republic of Turkey. Any disputes shall be subject to the exclusive jurisdiction of the courts and consumer arbitration committees of Istanbul, Turkey.
If any provision of these Terms is found unlawful, void, or unenforceable, that provision shall be severed and shall not affect the validity of the remaining provisions.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Calquate regarding your use of the App.
